Kershaw County Farmers Market

2026 Vendor Rules

This is the beginning of the application. The end of this form is NOT the end of the application. You will be led to another page where you will have an option for a specialized application for your business.

Operating Times & Dates

The regular Market season opens on the first Saturday in April and runs through the Saturday before Thanksgiving.

The Market operates rain or shine.

In rare instances the Market may be cancelled or need to close early due to severe/unsafe weather conditions that may pose a threat to the vendors or the public. Vendors will be notified either through email or text in such cases.

Hours are 9:00 a.m. - 12:00 noon. Vendors must be in place by 8:30 a.m.

Vendors are expected to remain open during market hours. Arriving late and/or leaving early may impact the vendor's ability to participate in future markets. If an emergency arises and you need to leave early, please speak to the site manager first.

Vendors who have opted in for a Saturday are expected to give 24-hour notice if they will not be attending a market. Repeated late arrivals or absences, with or without notice, will affect vendor status.

General Rules:

Kershaw County Farmers Market does not discriminate based on basis of color, religion (creed), race, gender, gender expression, age, national origin (ancestry), disability, marital status, sexual orientation, or military status.

Under the Internal Revenue Code, all section 501(c)3 organizations are absolutely prohibited from directly or indirectly participating in, or intervening in, any political campaign on behalf of (or in opposition to) any candidate for elective public office (including the publishing or distributing of statements) any political campaign on behalf of (or in opposition to) any candidate for public office.

The Kershaw County Farmers Market is not responsible for any loss, damage, or destruction of personal property, equipment, and/or valuables. Vendors are responsible for their own personal and property liability insurance.

The policies and guidelines in this document are determined by board approval and may be changed to protect the well-being of the Market, its patrons, vendors, staff, and volunteers. Vendors will be notified of any significant changes. Failure to abide by these policies will result in corrective action up to and including expulsion of vendors and/any sellers from the market.

Vendors are expected to act considerately, no hawking or inappropriate behavior.

Items and behavior must promote a family- friendly environment.

All vendors must complete and sign a vendor application and have a copy of all required documents to be approved by the Board as a vendor.

Space is competitive and not every applicant can be placed. Vendors are juried on a variety of weighted inputs, not any one factor alone. Vendors in some categories may be rotated on schedule to provide variety. We strive to balance the products offered to ensure the success of vendors and to avoid over-saturation of any one type of product.

Priority is given to vendors selling "groceries" - fruits, vegetables, fruit & vegetable plants, meats, eggs, sauces, jellies, pickles, baked goods, etc.

The Board reserves the right to prohibit anyone from selling at the market and to withdraw privileges of any vendor at their discretion.

The Board has the right to visit the vendor's production location by appointment.

Vendors will treat each other with respect and will not interfere with customers standing at their site. If issues arise, please contact the site manager.

Solicitations for products, services, or charitable contributions are not permitted without permission from the site manager.

Vendors may ONLY sell products listed on the application that was approved by the Board. If a vendor wants to add product(s) to their booth, another application MUST be submitted for every additional product. There is no guarantee that new item applications will be accepted.

No Smoking or vaping is allowed on Kershaw County Farmers Market property.

City of Camden Plastic Bag Ordinance states that NO single use bags are to be used unless brought by the customer. You may use paper bags, biodegradable bags, or reusable bags.

Products That Can Be Sold:

PRIORITY WILL BE GIVEN TO FARMERS, THEN FOOD VENDORS, THEN ARTS & CRAFTS/OTHERS. KCFM IS A CURATED MARKET, MEANING THAT NOT EVERYONE WILL BE APPROVED AUTOMATICALLY, TO AVOID OVER-SATURATION OF AN ITEM.

Farmer or Grower - Any person who is directly involved in the local production of agricultural products, produce, or plants in South Carolina is welcome as a vendor. Farmers may offer resale produce/products to compliment sales IF the products are clearly marked "resale".

Livestock and livestock products - This category includes meats, cheeses, eggs, farm-raised fish, honey, wool, and other products which are derived from animals. All livestock must be raised in a humane manner, with the utmost care taken to insure the health and well-being of the animal.

Food Vendors- Food items, or items made for consumption, that are made on-site are permitted as long as the appropriate permits are obtained and that all DHEC procedures are followed. Home-based food items must meet SC Cottage Food Law. All other food vendors must operate out of a DHEC approved facility. It is the vendor's responsibility to ensure that they are compliant and that they have a letter of proof from DHEC.

Arts & Crafts - Local artists and crafts-persons who make their own original product may become a vendor if approved. Priority will be given to those who produce largely from natural materials and/or original sources. RESALE OF ARTWORK OR CRAFTS IS NOT PERMITTED.

Brick & Mortar resellers and direct sales vendors are allowed on a limited basis at the discretion and approval of the board.

Licenses, Inspection Requirements, Insurance & Taxes:

Vendors must meet all applicable local, state, and federal regulations, inspections, and labeling requirements for products they sell.

Adequate proof of current compliance must always be provided and available for inspection.

APPLICATIONS WITHOUT CORRECT ATTACHMENTS SHOWING THEIR PRODUCTS MEET REQUIREMENTS FOR SALE WILL BE DENIED.

Vendors of livestock products for human consumption (meat, dairy, cheese, eggs, fish, and any products made from such) and all food vendors must furnish a current copy of their liability insurance policy with application, and yearly thereafter.

Vendors are responsible for their own local and state licenses, permits and taxes, including a City of Camden business license.

Booth spaces:

Spaces are marked in 10'x10' sites, some allow for a car parked behind the space.

Spaces may be reserved for the season in advance with payment received before April 15.

Food trucks must be in place by 8 a.m. and all other vendors must be in place by 8:30 a.m.

If a vendor is not in their assigned booth space by this time, and no call or text has been made to the site manager in case of emergency, the booth space will be considered vacant and that vendor is noted as a 'no-show'.

Repeated no-shows will affect vendor status.

Vendors will maintain clean and safe sites including a 5' perimeter around their booth site and will remove all trash at the end of the day.

Vendors are responsible for their own tent, tables, scales, displays, etc. used for sale of their products/goods.

Tents must be in good condition, with 35 lb. minimum weights on each leg.

Management:

There will be a Market Coordinator whose job is to be at the market on Saturdays to make sure vendors are in their correct booth, to deal with vendor issues that can be resolved immediately, who is expected to be found in a dedicated KCFM "information" booth during the regular April - November season, to answer questions from vendors and patrons, to coordinate volunteers, and to assist the Business Manager.

Advertising & Social Media:

KCFM advertises the Market and promotes the Market, Market Events, and other organizations or events that are local, or have agricultural or educational benefit to all followers at large. It is not in the KCFM mission statement to promote or tag vendors on social media outlets. We will make an effort to highlight vendors at the markets fairly and evenly.

Hold Harmless Clause:

I hereby agree to indemnify and hold harmless the Kershaw County Farmers Market, its employees, officers, agents and/or contractors for and against any and all damages, losses, suits, liability and/or causes of action resulting from property damage, and/or from personal injury including death, of myself arising out of or in any way connected with our participation in the Kershaw County Farmers Market, except to the extent that such damage or injury is caused by the gross negligence or willful misconduct of the Kershaw County Farmers Market, and covenant not to sue or take action against the organization, its employees, officers, agents and/or contractors except as set out herein. I further permit the Kershaw County Farmers Market to use photographs or videos of me and my products for market publicity.

All vendors participating in the Kershaw County Farmers Market must abide by these rules. The Kershaw County Farmers Market or its registered agent shall enforce all rules and regulations and reserves the right to update and/or change the guidelines and rules at any time deemed appropriate by the Board of Directors.

Permission to participate in the Market can be revoked by the Market.
